This Clarification Notice has been prepared by Beymetal Alüminyum San. ve Tic. Ltd. Şti., acting in the capacity of Data Controller, in accordance with Article 10 of the Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

Purposes of Processing Personal Data

Your personal data shared by you may be processed by our Company for the following purposes, including but not limited to: enabling you and/or the institutions and organizations you represent to benefit from the products and services offered by our Company; determining and implementing our Company’s commercial and business strategies; carrying out marketing activities; and performing business development and planning activities; conducting administrative operations related to communication carried out by our Company; ensuring the physical security and supervision of the locations used by our Company, including emergency preparedness and response operations, occupational health and safety processes, accident and regulatory management within the scope of occupational health and safety, workplace entry and exit records and image recordings obtained through closed-circuit security camera systems (CCTV); establishing relationships with business partners, customers, and suppliers (including their authorized representatives or employees); fulfilling contractual obligations and ensuring financial reconciliation regarding products and services provided jointly with our business partners, suppliers, or other third parties; conducting our Company’s human resources policies, including creation of personnel files, payroll processes, management of employee contract processes, execution of insurance renewal processes, provision of healthcare services to employees, maintenance of blood type lists, allocation of vehicles, mobile phones, and phone lines to employees within the scope of employment contracts, execution of power of attorney and signature circular procurement processes, and conducting compliance evaluations within the scope of subcontracting; contacting our Company’s call center or using our website; participating in events and organizations organized by our Company; assessing the qualifications, experience, and suitability of job applicants for open positions, verifying the accuracy of the information provided by job applicants when necessary, communicating with job applicants regarding application and recruitment processes, contacting job applicants for future suitable positions, and referring them to affiliated companies where appropriate; and planning, auditing, and executing our Company’s information security processes, including creation and authorization of employee email accounts and retention of internet log records.

Transfer of Personal Data

Your personal data processed within the scope of the purposes stated above may be transferred, in accordance with the fundamental principles set forth in the KVKK and pursuant to Articles 8 and 9 of the KVKK, for the purpose of carrying out the aforementioned processes, to authorized companies and representatives acting on behalf of and for the account of our Company; regulatory and supervisory authorities and public institutions or organizations legally authorized to request personal data under applicable legislation; business partners, contractors, suppliers, banks, credit risk and financial institutions, and other natural or legal persons; tax and other consultants, parties required for legal proceedings, institutions and organizations, auditors, and other third parties from whom we receive consultancy services, both domestically and internationally, provided that such transfers are made for the purposes specified above.

Transfer of Personal Data

Your personal data may be transferred abroad by Beymetal Alüminyum San. ve Tic. Ltd. Şti., in accordance with the principles set forth in Article 4(2) of the KVKK, either based on your explicit consent or, where applicable, without explicit consent in the presence of conditions specified in Articles 5(2) and 6(3) of the KVKK, and in compliance with Article 9 of the KVKK. Such transfers may be made to persons and organizations located only in countries declared by the Personal Data Protection Board (“Board”) to have an adequate level of protection. For countries that are not declared to have adequate protection, transfers may be made only where the data controllers in Türkiye and the relevant foreign country have provided a written undertaking guaranteeing adequate protection and where permission has been obtained from the Board for the relevant transfer.

Method and Legal Grounds for Collecting Personal Data

Your personal data is collected for the purpose of carrying out our activities through various channels, including but not limited to employee declarations, business cards, career websites, ERP software, human resources systems and software, forms, suppliers, logging systems, email communications, and other communication channels, based on the legal grounds specified above.

The personal data collected during this process is securely obtained in physical and electronic environments throughout the commencement and continuation of the business relationship, in order to perform the processes listed above and to conduct our commercial and operational activities.

Within this framework, your personal data may be processed and transferred either based on your explicit consent or, where applicable, without explicit consent in the presence of conditions specified in Articles 5(2) and 6(3) of the KVKK, in accordance with the principles set forth in Article 4(2) of the KVKK.

Rights of the Data Subject under Article 11 of the KVKK
